TERMS OF USE

These Terms of Use are an integral part of a distance contract, entered into by the parties on the basis of customer’s orders in our online store www.livikodrinks.lv Terms of Use contain mandatory obligations. Violation of these Terms of Use may constitute a basis for termination of the distance contract. The contract stays in force for indefinite period.
When making an order, the customer confirms having read, understood and consent to the Terms of Use. The customer is not allowed to order goods from our online store www.livikodrinks.lv unless the customer has read and agreed to the Terms of Use.
1. TERMS USED IN THE DISTANCE CONTRACT
livikodrinks.lv – owner of online store www.livikodrinks.lv, licence No. MT Nr. 0000000554, is SIA “Liviko”, registration No. 50103154841, licence No. 50103154841.: ………………………, legal address – Duntes 23a, Riga LV-1005, Latvia, offering and selling goods to a customer within the framework of its economic operation in compliance with present Terms of Use;
Customer – natural person ordering goods from www.livikodrinks.lv, at least 18 years of age and without restricted capacity to enter into a contract with livikodrinks.lv;
Livikodrinks - online store www.livikodrinks.lv, used by the customer for placing an order;
Delivery - delivery of goods ordered by the customer with a courier to an address which was written in the form when placing the order.
Delivery zone - Riga and adjacent territories (Riga, Kalngale, Carnikava, Garciems, Garupe, Kadaga, Baltezers, Ādaži, Līči, Upeslejas, Mežezeri, Annuška, Ulbroka, Upesciems, Sunīši, Langstiņi, Mucenieki, Salaspils, Krogsils, Baloži, Olaine, Ķekava, Medamciems, Jaunolaine, Jaunmārupe, Mārupe, Tīraine, Mežāres, Babīte, Sēbruciems, Piņķi, Beberi and Babīte).
Livikodrinks store – retail store Livikodrinks.lv, address: VIA 3L Latvia, Latgales iela 495, Ropažu, Stopiņu pagasts, Ropažu novads, LV-2121.
Distance contract − when using the online store, www.livikodrinks.lv and customer enter in a contract on delivery of goods, stipulating rights, obligations and responsibility of the parties.
2. ORDERING OF GOODS
2.1 The Customer may use the services of Livikodrinks and place an order as follows:
2.1.1 When registering:
the Customer must create a customer account by using his/her e-mail and password.
In order to create a customer account, additional information must be provided: name, surname, contact info, password.
2.1.2 Order goods as a guest:
Before placing an order a guest must provide the following information: name, surname, contact info and address should the customer choose Delivery to specific address. When choosing a pick-up option, address field is not required.
2.2. The Customer shall provide true and correct information. After registration the Customer is fully liable for non-disclosure of Customer’s account password to third parties. The Customer is fully liable for all activities made from the Customer’s account. If other person uses the Customer’s account, Livikodrinks is in a right to believe that these actions are taken by the Customer. If the Customer loses Customer’s credentials, the Customer shall inform Livikodrinks by phone or e-mail, which is available at www.livikodrinks.lv
2.3 Notifications on execution of order (for example, order confirmation, invoice, cancelling of order etc.) will be sent to the Customer whether or not he/she chose to receive notifications and offers, because these notifications are mandatory for execution of order and updating the Customer about the order status.
2.4 Customers’ personal data will be used for order execution and delivery, preparation of invoice documentation, reimbursement of excess payment and for returned goods, administration of financial liabilities and other liabilities arising out of these Terms of Use and distance contract, as well as ensuring other services provided by Livikodrinks. For more information about personal data processing refer to Section 10 of these Terms.
3. PRICE, PAYMENTS AND DELIVERY COSTS
3.1 Product prices in Livikodrinks are provided in EUR currency. All prices are shown with any value added tax. Products are sold at a price shown when placing the order. Total Delivery price may include additional costs. Bank fee may be applied depending on the bank used by the customer.
3.2 Prior to the payment the Customer must confirm that he/she is at least 18 years of age, by using one of age verification tools offered by Livikodrinks – Smart ID, eID card or eParaksts mobile.
3.3 The Buyer shall pay for the goods in one of the following ways:
3.3.1 Payment card: pre-payment with valid Buyer’s MasterCard, VISA or VISA Electron debit card or credit card. When entering credit card or debit card data and paying with a credit card or debit card, Customer does not leave his/her data at Livikodrinks system, because in order to make a payment operation the Customer is directed to the service provider’s server.
3.3.2 Payment during the order through PayPal services. Responsibility for Buyer’s data protection during the payment in this case is taken by relevant service provider since all monetary operations take place in PayPal system.
3.3.3 The Customer may pay for goods with a bank transfer by paying for the invoice issued by Livikodrinks. The payment must be made before receiving the goods. Once the payment is received, the goods will be dispatched and delivery time will be coordinated with the Customer. Responsibility for Buyer’s data protection during the payment in this case is taken by relevant bank since all monetary operations take place in Bank’s system.
3.4 The Buyer may choose one of delivery modes:
3.4.1 Free of charge pickup of goods at Livikodrinks store.
3.4.2 Courier delivery to the specified address in the Delivery zone.
In addition to the price, the Customer will have to pay delivery fee for delivery services to the specified address in Riga and adjacent territory, which amounts to 5 EUR if total value of goods to be delivered is 49.99 or less. No delivery fee is payable if total value of goods to be delivered exceeds 49.99 EUR.
4. COLLECTING AND DELIVERY OF PRODUCTS
4.1 Livikodrinks try to put best efforts to ensure that each order is completely fulfilled, however on the moment of ordering due to unavailability of some products Livikodrinks does not guarantee that all products ordered by the Customer will be available and delivered. If the price for the goods delivered is less than what the Buyer has paid, a difference between the paid and actual amount shall be reimbursed to the Buyer’s account not later than within 5 (five) business days of paying the order.
4.2 The order will be delivered to the Customer or prepared for pickup at Livikodrinks store on the next business day of filling out the order form and receiving of payment if the order was paid before 2.00 pm.
If the order was placed and paid later, you it  will be delivered or prepared for pickupaccordingly one day later. The Customer will be notified about delivery time/readiness of the order to be picked up at the store by using the Customer’s contact info.
4.3 Deliveries will be ensured during business days between 12.00 and 17.00.
4.4 Delivery will be made to the address specified by the Customer when placing the order. Livikodrinks will deliver Customer’s order to the main entrance at the delivery address.
4.5 If Customer is not the Recipient of the order name and last name of the Recipient used to be added to the comment field at the moment of order placement. The goods can be received by an adult, at least 18 years old, by presenting an ID document for confirmation of age. If a document proving the age is not available at the moment of delivery the products will not be delivered.
4.6. In cases where we deliver Customer’s order at the time specified by the Customer but nobody is at the address eligible for picking up the delivery, the Customer will be informed and the Customer will have to contact us to agree on a new delivery time. In such cases, if Livikodrinks must deliver the order repeatedly, the Customer will have to pay additional 5 EUR for delivery.
4.7 Livikodrinks takes all efforts to ensure that Customer’s order is delivered during the next business day, Livikodrinks does not undertake any responsibility for failure to comply with this provision or if this delay was caused by the Customer or any other unavoidable circumstances.
5. QUALITY GUARANTEE AND RESPONSIBILITY
5.1 Product manufacturer and/or distributor is liable for information about all Livikodrinks products’ characteristics. Livikodrinks ir responsible only for displaying this information to the Customers unless stipulated otherwise in laws and regulations.
5.2 In cases where, according to laws and regulations, the goods have expiry date, Livikodrinks undertakes to sell to the Buyer goods with a realistic expiry date so that the goods can be reasonably consumed before it.
6. RIGHT OF CANCELLATION AND RETURN OF GOODS
6.1 The Customer is entitled to unilaterally exercise the right of cancellation within 14 days of receiving the order, by promptly notifying Livikodrinks accordingly. The Customer shall bear the costs related to such return of the order.
6.2 When returning the goods to the store, they must be free from any damage, in the original packaging, unopened, within the expiration date + 1 day. If the Customer is not able to meet these requirements, Livikodrinks reserves a right not to reimburse the costs of the goods returned.
6.3 If the Customer has found out after receiving the order that the ordered goods are damaged and/or of poor quality, the Customer shall address Livikodrinks with a submission supported with a photo of the damaged goods and Livikodrinks shall organise reimbursement to the Customer’s account from which the payment was made. Livikodrinks reserves a right to request the Customer to return entire damaged goods to the store from which they were delivered.
7. CANCELLATION OF ORDER
7.1 On serious grounds Livikodrinks may temporarily or fully discontinue online sales without prior notice to the Customer. In such cases Livikodrinks will reimburse the Customer an amount equal to the undelivered orders within 10 business days.

9. FINAL PROVISIONS AND SETTLEMENT OF DISPUTES
9.1 Livikodrinks may make unilateral changes in these Terms of Use.
9.2 These Terms of Use are prepared according to and they are governed by the laws and regulations of the Republic of Latvia and all disputes are subject to the courts of the Republic of Latvia.
9.3 If the Customer believes that Livikodrinks has violated these Terms of Use or any other applicable laws and regulations, and it has affected Customer’s ability to use their rights and this situation cannot be resolved amicably, the Customer may file a submission to the national consumers’ protection authority – Consumer Rights Protection Centre.
10. DATA PROCESSING AND PROTECTION
10.1 Customer’s personal data will be used to identify the Customer and to receive the order, place an order and deliver it, prepare accounting documents, including an invoice, pay the excess amount and return the amount for the returned products, administer financial obligations and other obligations which arise from these Terms of Use and distance contract, as well as for use of the services offered by Livikodrinks.
